A. SimplyMoi ("we", "us" or "our") offers the services accessible on this site to you subject to set Terms and Conditions.

B. These terms and conditions ('the Terms') govern the users ('you' or 'your') use of SimplyMoi ("we", "us" or "our") website, simplymoi.com ('the Website').

C.By using our site, you acknowledge that you have read, understand, and agree, without limitation or qualification, to be bound by these Terms and Conditions.
We reserve the right to amend this Terms at any time without prior notice to customers. We also advise you to read our return/refund policy before placing an order at any time. If you do not agree with Terms & Conditions, and return/refund policies, please discontinue to use the site.

3. Eligibility
To be eligible to purchase products on this Site and to legally enter into and form contracts with us under English law you must: (1) be aged 18 or over; (2) be the rightful holder of a valid debit/credit card and (3) not wilful provide false information impersonating someone else.

4. Creating an account
A. You agree that the personal information you provided when you register as a customer is factual, accurate and current in its entirety. See our Privacy Policy regarding the treatment of your personal information.

B. It is your duty to ensure that the personal information you provide to us is up-to-date. If your personal information changes, then please notify us immediately by contacting us. Alternatively, you can update your details through the "My Account" page.

C. It is your responsibility to maintain the confidentiality of your account details and password and to take all reasonable actions to avoid unauthorised access to your account. You agree to accept responsibility for all activities that occur under your account or password. If you have reason to believe that someone else knows your password, or it is likely to be used in any way that is unauthorised by you, you should contact us immediately.

D. If you forget your password, we will reset it upon your request and send it to the email address, currently registered with us. Your account can be cancelled at any time by contacting us.

E. You agree not to impersonate any other person or entity or to use a false name or a name that you are not authorised to use.

F. We reserve the right to refuse service and/or terminate accounts without prior notice if you violate these Terms and Conditions or if we decide, in our sole discretion, that it would be in SimplyMoi’s best interests to do so.

5. Privacy Policy
Our Privacy Policy has been created to assure you that we acknowledge and absolutely respect the privacy and personal data of the visitors to our website. It also sets out to how we collect and protect your personal information we collect from this website.

 

6. Transaction processing & security

We accept payments in Pound sterling (£GBP). We do not store credit card details nor do we share financial details with any 3rd parties. Our payment gateway is PCI compliant and secured. No cardholder information is ever passed unencrypted and are signed using MD5 hashing to prevent tampering.  

 

7. Prices
A. The prices of goods on our store may vary from time to time, but changes will not affect any order which we have confirmed. All prices are quoted in GB Pound Sterling and include VAT (where applicable) at the applicable current rate chargeable in the UK for the time being.

 

B. We take reasonable care to make sure that prices of goods are accurate at the time when the relevant information was entered onto the system. However if we discover an error in the price of the products you have ordered we will inform you of this error and we will give you the option of continuing to purchase the product at the correct price or cancelling your order.


C. We will not process your order until we have your instructions. If we are unable to contact you using the contact details you provided during the order process, we will treat the order as cancelled and notify you in writing. Please note that if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as a mis-pricing, we do not have to provide the products to you at the incorrect (lower) price.


8. Product information
We aim to ensure that all information, descriptions, photographs and prices of products appearing on the Site are correct at the time when they were uploaded onto the Site. Nonetheless, there are times when the information provided on this site, including product descriptions may e inaccurate at the time you place an order.

9. Placing an order
When you place order on our website, you will be assisted through the process via an easy simple instructions on the Site. At the final stage of placing your order, you may review your order and confirm or correct it before processing the submit button to complete your order. After you have placed your order, we will send you an email of acknowledgement; providing details and value of your order that has been debited to your credit/debit card. Please note that this is not an order acceptance from SimplyMoi Ltd. We may not be able to fulfil your order if an item you have ordered is out of stock, if we are unable to get authorisation for your method payment and or for any other reason. Accepting your order and completing the contract between you and us will take place when we have dispatched the goods you ordered, unless we have notified you that we have rejected or cancelled order.

 

10. Order Amendments

Once an order is placed, it instantly enters our round-the clock, automated shipping process. This enables us to dispatch your order quickly so we can meet the 24 or 48 hour delivery timeframe you have selected. As such, we may not be able to cancel your order on time or make any changes to delivery addresses, email addresses, size, colour, fragrance, adding, swapping/removing an item and so forth. Nevertheless, this does not affect your eligibility to return.

 

When one or more separate orders are from the same customers with the same delivery address, we reserve the right to merge the orders to save the customer from paying full packing & postage (P&P) fee twice. A partial refund for P&P is issued for one of the orders with a £1.75 administration & transaction fee deducted from the refund. We are unable to merge orders if one of the orders has already been separately picked, packed and assigned a tracking number.

11. International customers & orders

A. For all deliveries to locations outside the United Kingdom, you shall be deemed the importer of the products and it shall be your sole responsibility to comply with all applicable local laws and regulations of the country to which the products are delivered. You shall be solely responsible for any payments such as  import duties and taxes. SimplyMoi has no control whatsoever in respect of such additional import duties, taxes and charges and we cannot advise you what these may be. Consequently, We recommend that you contact your local customs office for further information prior to placing an order with us.


B. Our courier may require to collect your parcel at any of their collection point nearer to your shipping address.


C. SimplyMoi does not represent or warrant that the website or the products made available for purchase are appropriate or lawful in locations outside the United Kingdom, or that the products and/or the delivery thereof comply with any legal or regulatory requirements of any applicable local law of the location in which you are currently situated.


D. SimplyMoi shall in no way be liable to you or any third parties for any breach by you of any such laws arising from or in connection with the purchase of the products and/or SimplyMoi’s delivery of the products to you.


E. In event the wrong size of a product was sent out to you, we will refund the difference in product cost and also offer a discounted refund on the original shipping cost you paid.

 

12. Gift Voucher

Our voucher can be used in conjunction with other methods of payment and is redeemable against anything on our site within 12 months of purchase date. Gift vouchers are non-refundable. 


13. Loyalty Clique reward scheme

With SimplyMoi’s Loyalty Clique, you earn 4 points for every £1 you spend on products. Each time you place an order or sign into your account, the amount of points you accrued so far will be displayed. Customers will also receive an email whenever they are earned and spend points. You can redeem your Loyalty Clique points at the checkout when you have collected a minimum of 500 points, which is equivalent to £5. Points cannot be redeem in conjunction with any other discount or on sale item. We reserve the right to cancel, withdraw or amend point system without notice. If your order is canceled or refund, we will deduct the loyalty points gained when the order was placed.

 

14. Ownership of goods
We will preserve the lawful ownership of the goods until we have received your full payment to us. If we refund any payment to you, legal ownership of the goods will revert back to us



15. Dispatch & Delivery

A. Dispatch and delivery timescales provided are only suggestive and are subject to delays or changes, particularly during the pandemic, busy sales periods and holiday seasons.

 

B. 24-hour delivery represents 1 business day after dispatch, 48-hour delivery represents 2 working days after dispatch, and services excludes weekends and public holidays.  

 

C. FREE delivery are valid on orders (minus any shipping cost) £50 or more. We will deliver the goods in accordance to the delivery option you selected when you were placing an order.  For a large value/volume or high risk orders, you may be required to collect your parcel at a courier point. More than one high valued order placed within a 36-hour period, by the same customer or containing the same delivery address, may be dispatched separately. This is usually one or two days apart.

 

D. Couriers may also take longer than usual to deliver. Consequently, you may not receive your order within your chosen delivery timeframe. We do not take any responsibility for delayed delivery caused by any third party courier or business, any resulting consequential loss or damage suffered. We reserve the right not to refund shipping fees due to late dispatch and/or delivery. If any of our items is out of stock at the time you place your order, we may despatch the rest of the order when it is available.You further acknowledge and agree that estimated turnaround time shall be dependent on your location (for example remote areas of the country) and that delivery may not be possible to certain destinations within advertised timeframes.

 

E. If delivery attempt is unsuccessfully, it is your responsibility to make an arrangement with the courier via tracking details found on their site to have your parcel collected (recommended option) at your local depot or redelivered to your address. We are not responsible for any additional delivery cost incurred or any discrepancies you may have with the courier when you make redelivery arrangement with them.  Failure to collect your parcel or make arrangement for delivery within 10 working days, may result in your parcel being returned to us. Upon receiving your returned parcel, we will issue a refund for the goods. We reserve the right not to issue the cost you paid for delivery when you placed your order. 

 

F. If you fail to accept the goods upon delivery or collection at the courier's depot or access point, you may also incur the cost of delivery (this also includes orders with FREE delivery) or any other expenses reasonably incurred by us as a result of failed delivery attempts or collection. Such cost may be deducted from your refund, where applicable.

  

G. We reserve the right to refuse to post to an address, location where we or our courier has previously encountered delivery discrepancies or fraudulent order.

 

H. We are unable to refund, replace or take responsibility for any order that goes missing in the postal system due to incorrect shipping address provided by the customer. 

 

16. Receipt of goods

A. When you received your goods, you must inspect the goods. You will be considered to have accepted the goods in its state, except you notify us that you have cancelled the order and/or you return the goods according to our Returns Policy. If no such action is taken, we reserve the right to reject any goods you want to return at a later date. Your statutory rights are not affected.

B. If you did not received the entire order as detailed in the order acknowledgment email sent to you, it is vital that you let us know within 3 days after delivery. If we do not hear from you after the 3 days has passed, your good (s) will be deemed as delivered successfully and we receive the right to deny any request for a refund and/or replacement.  

C. If you are in receipt of duplicated deliveries for the same order, we will take the necessary steps to have one of the parcel and content returned to us. If you refuse to return the duplicate, we may pass on your information to a third-party and take legal action against you. A permanent banned from shopping with us, will also be imposed.

 

17.  Missing Parcel
A. Claim for missing or lost parcel must be made within 5 working days after being notified that your order has been dispatched. We will take a reasonable time to track the parcel and establish its whereabouts. If the parcel is located we will arrange for it to be delivered to you as soon as possible. If it is deemed lost upon investigation, we will send out a replacement.

 

B. Where tracking information and other investigation carried out confirm that the parcel was delivered, but the customer claims otherwise, SimplyMoi reserves the right to refuse to issue a refund or send out a replacement. Where we have reasons to believe the customer is being dishonest , we reserve the right to blacklist and permanently banned the customer from shopping with us in the future. In addition, we may pass on your information to third-party agency such as our courier(s) and postal fraud prevention agencies.

 

 

18. Reviews/Testimonials

A. If you submit a review or testimonial to us via a product page or our contact form, then you agree that we may publish your testimonial on this website and any other marketing avenues but not limited to social media, flyers, brochures etc. You acknowledge that we may share your review with our brand suppliers for marketing research purpose.  

B. You further agree that we may edit the testimonial and publish edited or partial versions of the testimonial for grammar and clarity purpose. However, we will never edit a testimonial in such a way as to create a misleading impression of your views.

C. We reserve the right to refuse to publish a negative or neutral review submitted by a non-verified buyer.  

D. We also reserve the right to unpublish or delete a review which we may deemed unjustified and not genuine. 


19. Reselling or commercial redistribution of products
The products and services on this Site, including samples we provide to you are for personal use only. You may not sell or resell any of the products or services, or samples thereof; you buy or receive from us. We reserve the right, with or without notice, to cancel any order and banned a buyer that we believe, in our sole discretion, is a violation of Section 19. In the event that an order is cancelled due to this violation, we reserve the right to also charge 20% cancellation fee, which will be deducted in the refund of the violated order. Any discounts or reward points accrued prior to cancellation of an order and/or a buyer being banned, will also be withdrawn without notice. 

 

20. Refusal to process order

A. We reserve the right to refuse to process and/or fulfil any order we deemed is fraudulent, the address is incorrect/incomplete, customer has been abusive to staff or the order has been placed by a competing business for resale or any other purpose. 

B. We reserve the right to charge 15% cancellation and administration fee to cancel an order coming from a personal customer that is currently on our blacklist. We strongly advise not to put an order through if you have been previously notified that you have been banned or blacklisted from shopping with SimplyMoi


21. Third-party links
We shall take no responsible or liable for the content of any external web pages or Sites linked to or from the Site. Third-party links on the Site are for your convenience only and they are not an endorsement by us, our affiliates or our partners of the referenced content, product, service, or supplier. Your linking to or from external web pages or other Sites is at your own risk.

22. Intellectual property
All the content on the Site, including, but not limited to, text, graphics, logos, button icons, images, audio clips, data compilations, and software, and the compilation thereof (collectively, the "Content") belongs to SimplyMoi, our partners, our affiliates or our licensors, and is protected by United Kingdom and international copyright laws. The trademarks, logos, and service marks displayed on the Site (collectively, the "Trademarks") are the registered and unregistered marks of SimplyMoi, our partners, affiliates or licensors, in the United Kingdom and other countries, and are protected by United Kingdom and international trademark laws. All other Trademarks not owned by us, our partners, affiliates or licensors that appear on the Site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by us. Neither the content, the Trademarks, nor any other portion of the Site may be used, reproduced, duplicated, copied, sold, resold, accessed, modified, or otherwise exploited, in whole or in part, for any purpose without our prior written consent from us.

23. Media articles or videos from social media personalities
SimplyMoi does not accept any responsibility whatsoever for any social media personality or general online/off line publication endorsements via videos, comments, posts, statuses or articles displayed on this Site. All content have been republished on the site as they were originally printed. Any incorrect claims or endorsements are the responsibility of the original publisher.

24. Indemnity
You agree to defend, indemnify and hold us harmless for any loss, damages or costs, including reasonable attorneys' fees, resulting from any third party claim, action, or demand arising from your use of the Site or any other person accessing the Website using your personal information.

25. Compliance
A. When you access or use this site, you shall abide by these Terms and Conditions. Your use of this Website and any purchase by you of any goods from SimplyMoi Ltd shall be governed by English law and the parties here to submit to the exclusive jurisdiction of the English courts.

B. The Website may only be used for lawful purposes and in a lawful manner. You agree to obey with all applicable laws, statutes and regulations regarding the Website and its use. You agree not to upload or transmit through the Website computer viruses or anything that is created to interfere with, interrupt or disrupt the normal operating procedures of a computer; and any material which is defamatory, offensive or of an obscene character.

C. You acknowledge and accept that these Terms and Condition establish the complete and exclusive agreement between SimplyMoi and you with regards to your use of or purchases on the Site, and replace and oversee all previous proposals, agreements, or other communications. We reserve the right, in our sole discretion, to change these Terms and Conditions at any time without giving you prior notice.

26. Miscellaneous - COVID-19 

Due to COVID-19 pandemic, there is an industry shortage on specific ingredients and some manufacturers are operating under restrictions. As a result, stocks are limited and our customers are currently allowed 1 quantity per product within a 30-day period for certain products. This temporary policy is to give each customer a fair chance at getting what they want. Multiple orders from the same customer is subject to cancellation if this rule is not adhere to. Please also be aware that the industry is currently experiencing an insufficiency of plastic bottles/jars & dispensing supplies. Some items may be temporarily unavailable or may arrive to you in a different packaging  that's different from what is shown in on our website. Rest assured that this is not indicative of a formula or volume/size change.
